Here are the benefits and drawbacks to early possession in a transaction.

What does early possession mean, and what are the benefits and pitfalls of it? 

One of the great things about early possession is that your clients can move into the home before the loan is finalized or it can ease the stress if they have multiple closings in one day. It also means the seller may receive some rent that can help with their carrying costs.

However, there are also some drawbacks to early possession. People can have buyer’s remorse; the buyer moves in, then finds out they don’t like the house as much as they thought. They may decide not to pay the seller rent because they’re already in the home and the seller is in a bind because they have to pay that mortgage and want the transaction to close. The buyer could also find issues with the house or cause damage. Additionally, there’s the possibility that the buyer doesn’t get their loan and isn’t able to buy the property.

These problems can accumulate and add many expenses to the seller. So the risks are high. Many sellers and builders refuse to allow early possession.

When handling early possession, it’s crucial that everyone trusts one another, you get everything in writing, and the seller feels comfortable that the buyer will take care of the home. Knowing the loan and mortgage timeline is also essential in these circumstances because the possession could last two weeks or two months.

Some alternatives to early possession are allowing the buyers to store items in the garage or a pod, then they find somewhere else to sleep for the interim. The two crucial things to consider for the buyer are where their possessions will go and where they’ll sleep.

Sometimes builders have short-term housing people can rent if their home isn’t ready yet, and occasionally brokers may have a couple of rental houses for the same purpose. I own a few properties I can house buyers in if we find ourselves in this situation. 

Remember that you can let the deal fall apart if it needs to; you don’t have to always keep it together when it comes to possession because there are many risks involved.
